YERIMA DAYS ARE NUMBERED....A MAN SENTENCED TO 20-YEAR FOR MARRYING A 14-YEAR OLD CHILD


The Court of Appeal Friday confirmed a 20-year sentence handed to a man who “married” a 14-year-old girl in 2010.
Ezekiel Sonkoyo Friday lost his second and final appeal seeking to quash the sentence that was handed to him by a Kilgoris court after being found guilty of defiling the Form One student.
Sokonyo from Transmara District of Narok County, cohabited with a girl, who was a student at Siria Secondary School.
He took her to Eldoret from her home on August 17, 2010.
It took two months for the father of the girl to trace her and found her living with Sonkoyo as his wife.
Sonkoyo said he knew the girl was 14, but had sexual relations with her because he intended to marry her.
However, Lady Justice Ruth Sitati, who heard the first appeal, quoted the Sexual Offences Act, saying, given her age, the girl could not legally give consent.
The judge upheld the 20-year jail sentence, which the magistrate’s court had handed to Sonkoyo in her ruling delivered in January last year.
Sonkoyo then moved to the Court of Appeal, where he was heard in June. He insisted that he had been convicted on a defective charge sheet and that no one had reported to the police that the girl was missing.
But the Court of Appeal, sitting in Kisumu and constituted of Justices Onyango Otieno, Festus Azangalala and Sankale ole Kantai, upheld the ruling of the lower courts.
