I'M NOT GUILTY OF CONTEMPT......OBASANJO

Former president, Chief Olusegun Obasanjo, has filed an appeal against the ruling of the Federal High Court in Abuja, which ordered that his book, “My Watch” be confiscated after disobeying an injunction restraining its publication, saying: “I’m not guilty of contempt for publishing my book.”

Obasanjo, in his appeal, declared that the media reports which conveyed the impression that he intended to “dare confront a judge or the judiciary” were highly misleading.

Justice Valentine Ashie of the Federal High Court in Abuja had ruled on Wednesday, that irrespective of the public presentation, the former President erred by not obeying his court injunction.
However, Obasanjo, through his legal team, led by Gboyega Oyewole, filed an appeal challenging the confiscation order, declaring 10-grounds to support the appeal.
He argued that the trial judge erred in his ruling.

In the appeal with Suit No. CV/472/14, copy which was made available to journalists in Abeokuta yesterday, the counsel contended that Obasanjo was dissatisfied with the ruling of the court and “appealed against the said ruling upon the grounds set forth...”
Among the 10 grounds of appeal according the counsel, include that, “the learned trial judge erred in law when he granted interlocutory orders of injunction which inter alia restrained the defendant from the publication of his book or the content of the letter to the President which is the subject of the suit before the trial judge in the said book, “My Watch.”

They further backed with particulars, stating that:
(a) There was uncontradicted affidavit evidence that the defendant’s book “My Watch” had been published and released to the public before the making of the interlocutory order.
(b) “The plaintiff never alluded to this fact in his affidavit before the court.
(c) It is settled law that an injunction does not lie to restrain a completed act.
(d) His lordship failed and/or neglected to allude to the affidavit evidence before making the interlocutory order.

The learned trial judge erred in law and exercised its discretion wrongfully in granting the orders of interlocutory injunction subject of this appeal against the defendant restraining him from publishing his book, “My Watch” or publishing his letter subject of the suit in the said book. “
In a statement signed by Vitalise Ortese, which was made available to journalists in Abeokuta, the former president noted that “since the news of the said order broke, he (Obasanjo) has been receiving calls from concern friends from far and near and he is constrained to make this release and present the facts as they relate to the book and it’s public presentation.

The statement read: “Chief Olusegun Obasanjo wishes to state that the media reports which convey the impression that he intended to “dare or confront a judge or the judiciary” is highly misleading. Far from this, on the contrary, the former president is a law abiding citizen who will only pursue his rights within the law and will not “dare” a judge or knowingly flout an order of a Court of competent jurisdiction.

“The former president wishes to make it clear that in the first instance, no formal order from Justice Ashi was served and received by either himself or by proxy regarding any injunction restraining the publication of the book, “My Watch” which from the records was already in circulation.”
He noted that 10 points had been raised already for the court to clear, adding that the implication which is to suspend the enforcement of the orders until the application is determined, should not be lost on all concerned.

“The former President reiterates his regard for due process on judiciary and rule of law, and recognises that the order is from the court and not the governments it has been attributed in some quarters.”

MEET CRIMINAL MINDED 10-YEAR OLD BOY THAT BEAT 90-YEAR OLD WOMAN TO DEATH!!!

Tristen Kurilla, 10, from Pennsylvania, (pictured above), beat a 90 year old woman to death! And he is currently being held in the adult jail as he awaits trial.  According to Pennsylvania’s justice department, Tristen is the youngest person ever to face a murder charge in Pennsylvania.

Here's what he did. Tristen was visiting his grandfather in October this year. According to what he later told police, he entered the room of 90 year old Helen Novak who lived with his grand dad on Oct 11 to ask her a question. He said Helen screamed at him and told him to leave her room. He said he lost his temper, picked the woman's wooden cane and attacked her.

Police say Tristen beat her with the cane, hooked it around her neck and pushed it into her throat for a few seconds then punched her five times in the throat and several times in the stomach. There was no one else at the time of the incident to help Helen.

When the boy's granddad returned shortly and found Helen unresponsive, he called medics and the police. Tristen told police he'd only meant to hurt her, not kill her.

He is currently in adult jail though his lawyers are trying to get the courts to transfer the case to juvenile court and have Tristen moved to a youth detainment facility because of his age. That has not happened yet.

His parents are said to be devastated and claimed Tristen was such a good and kind boy who wouldn't a hurt a fly. Yeah, he skipped the fly and killed someone instead.

Tristen has since met with a psychiatrist and will next meet with the defense’s mental health expert

LAGOS POLICE COMMAND COVERING-UP THE COP THAT BRUTALISED UNARMED COUPLE !

ATTENTION - INSPECTOR GENERAL OF POLICE,NIGERIA
ATTENTION - ALL HUMAN RIGHTS ORGANISATION.
ATTENTION - ALL NIGERIANS.

ABUSE OF POWER TO TERRORISE AND HARM UNARMED NIGERIANS IS A CRIME
AND MUST BE ADDRESSED....ENOUGH IS ENOUGH!

29-year-old photographer, Ejeh Smith was brutalised by a policeman attached to the Ikoyi Police Division along with his wife, Grace, and the police has released a statement alleging that Mr Ejeh was drunk on the night of the incident.

He claims Mr Ejeh was drunk but managed to beat both of them to a pulp,he beat an unarmed woman..!
...look at their injuries!.....LOOK!

The police authorities added that the couple engaged the policeman in a scuffle, adding that since the incident happened, they had refused to make statements to the police.

The Police Public Relations Officer, Lagos State Command, DSP Kenneth Nwosu, told PUNCH Metro that the police had, however, detained the erring policeman, Dada Ogunsanya, assuring members of the public that justice would be served.

The Lagos police’s defence came as the Inspector General of Police, Suleiman Abba, ordered a full scale investigation into the case.

Punch reported on Wednesday Ejeh Smith, and his wife, Grace, were on their way home in a taxi they boarded at Obalende and the cab was reportedly stopped at the Lekki Roundabout by a team of policemen patrolling the area.
According to the taxi driver, Ndubuisi Iheaka, the police corporal checked the boot of the car before demanding for his driving licence.

Iheaka said while he was about getting the licence, Ogunsanya decided to beam his torchlight on his passengers.
The couple was said to have protested the action, telling him that the inner lights of the vehicle, which were on, was enough for him to see their faces.
The policeman reportedly asked them to alight after which an argument ensued, which degenerated into a scuffle.

In the process, Ogunsanya allegedly punched Ejeh in the face and also allegedly hit him in the face with the butt of his rifle. He thereafter slapped Grace and stepped on her stomach.
The Ikoyi Divisional Police Officer, Mrs Aisha Haruna, who arrived at the scene was accused by the couple of backing the policeman’s action.

The report of the torture, accompanied with the pictures of the couple at the time of the incident published by PUNCH Metro, had sparked rage.

A Lagos-based human rights lawyer, Femi Falana, constitutional lawyer, Prof. Itse Sagay and The PUNCH online readers, were among those who called for the sanction of the erring policeman in a follow-up report published on Thursday.

The police spokesman, Nwosu, while reacting to the reports, said the police had commenced disciplinary action against the corporal.
It was learnt that Ogunsanya had spent 11 years in the Nigeria Police Force.
He said, “Investigation is ongoing because as a command, we are alive to our responsibility and we do not condone any act of incivility to members of the public.
“However, the police corporal is alleging that the couple fought him in uniform. The man in question (Ejeh) was alleged to be drunk, and since that incident happened, he has refused to make statements to the police. If you have a good case, why will you say you don’t want to make statement?
“The Ikoyi DPO they are mentioning said she arrived at the scene and ordered all of them to be taken to the station. She was the one who even issued medical forms to them so they could go to the hospital.

“The man (Ejeh) told her (DPO) that he had taken her picture and would send it to his pastor to pray against her. I was told that he made the station uncomfortable. Can that be right? Is that the way to behave?
“We are interested in flushing out the bad eggs in the system and if this officer that has been accused is one of them, we will flush him out.”
He added that Ogunsanya had been transferred from the Ikoyi Division to the command headquarters where he was being detained.
While reacting to the police claims, Ejeh said he was not drunk on the night of the incident, adding that the police were merely cooking up allegations against him
“I was not drunk that night because I was coming from Ikeja where I worked. I met my wife at Obalende from where we took the cab. I was not drunk at all.
“I also fault the claim that I fought with the policeman because nothing like that happened. He was the one who hit me with his rifle in the eye, so how can a man who could barely see fight again?

“And yes, I told them I couldn’t make statement because my eyesight had been affected. I cannot see with one eye right now. I told our family lawyer about this and he said he would write a petition where he will state the case for us.”
Meanwhile, the Inspector General of Police, Mr. Sulaiman Abba, has ordered a full scale investigation into the case.

The Force spokesperson, Emmanuel Ojukwu, in a statement on Thursday, said all officers implicated in the case would be sanctioned.
He said, “The attention of the Police High Command has been drawn to a viral media story alleging police incivility to a couple in Ikoyi, Lagos.
“The Inspector-General of Police, Suleiman Abba, has ordered a full scale investigation into the matter in line with his avowed commitment to protect and uphold the human rights of all Nigerians and residents therein.

“The officer involved has been identified and is already undergoing administrative trial. All other officers whose conduct did not speak well in the incident are also being sanctioned, preparatory to further necessary action.”
The statement further said Abba would not condone any act of indiscipline, noting that any person or group of persons caught acting disorderly or abusing rights of members of the public would not only be punished internally, but would also be made to face the wrath of the law.

The IG of police should be vigilant on this case otherwise this will give other policemen the power to commit crimes against unarmed Nigerians, this is wrong, this is barbaric and must stop!

"Boko Haram started chasing us and we left the town. Our men fled to the hill top and we fled to the hospital but Boko Haram came, they did not shoot. They just came silently. They filled the hospital. I was pregnant when they abducted me. After a week I gave birth. Four days after I gave birth, we were moved. We refused to convert and young men took us to another place. They told me if I renounce my religion, they would take me to the Muslim household to be married off but I told them I would not change my religion.
